2. What These Terms Cover

These Terms & Conditions apply to the use of this website and to services provided by PAS, including but not limited to:

  • planning consultancy

  • desktop planning reviews

  • feasibility advice

  • planning drawings

  • architectural drawings

  • existing and proposed plans

  • planning application preparation

  • planning application submissions

  • lawful development certificate applications

  • prior approval applications

  • listed building and conservation-related support

  • planning statements and supporting documents

  • Building Regulations drawings where instructed

  • coordination with consultants, surveyors, engineers or other specialists where agreed

By using this website, submitting an enquiry, booking a consultation, accepting a quotation, paying an invoice or instructing PAS to carry out work, you agree to these Terms & Conditions.

3. Our Services

PAS provides practical planning, drawing and property-related support for homeowners, landlords, developers, investors and businesses.

The exact services we provide will depend on the quotation, proposal, invoice, email confirmation or written agreement issued for your project.

​

Unless specifically stated in writing, our services do not include legal advice, valuation advice, tax advice, conveyancing advice, structural engineering calculations, ecology reports, flood reports, highways reports, arboricultural reports, measured building surveys, party wall awards or any other specialist services.

​

Where needed, these may be quoted separately or provided by third parties.

4. Quotations And Instructions

Any quotation we provide is based on the information available to us at the time.

​

A quotation may include assumptions about the property, project type, application route, drawings required, council requirements, site constraints and the level of information provided by you.

​

You instruct PAS when you confirm acceptance of our quotation, make payment, book a paid service, approve work to begin or otherwise confirm in writing that you wish us to proceed.

​

We reserve the right to revise a quotation if:

​

  • the scope of work changes

  • new information becomes available

  • the property is more complex than first advised

  • the council requires additional information

  • specialist reports or drawings are needed

  • you request additional work

  • the project changes after instruction

​

​

5. Information You Provide

You are responsible for providing accurate and complete information about the property and project.

​

This may include:

​

  • full property address

  • ownership details

  • existing drawings or plans

  • photographs

  • previous planning history

  • listed building or conservation area information

  • details of previous extensions or alterations

  • access arrangements

  • project requirements

  • neighbour or site constraints

  • title or boundary information where relevant

PAS is entitled to rely on the information you provide. We are not responsible for errors, delays, additional fees or application problems caused by inaccurate, incomplete or misleading information supplied by you or by others on your behalf.

6. Planning Consultancy And Advice

Planning consultancy, desktop reviews and feasibility advice are based on the information available at the time of review.

​

Planning advice may include our professional opinion on likely planning routes, application types, risks, constraints, drawings, supporting documents or possible next steps.

​

Planning advice is not a guarantee that planning permission, lawful development certification, listed building consent, prior approval or any other consent will be granted.

​

Planning decisions are made by the relevant local planning authority or other statutory body, not by PAS.

​

​

7. Drawings And Plans

Where instructed, PAS may prepare or arrange planning drawings, architectural drawings or other project drawings.

​

Unless expressly agreed in writing, drawings prepared for planning purposes are not construction drawings and should not be used for building work, pricing, structural design, Building Regulations approval or site construction.

​

Building Regulations drawings, structural drawings and construction information must be separately instructed where required.

​

You are responsible for reviewing drawings carefully and notifying us promptly of any errors, omissions or requested changes before they are submitted or issued for use.

​

​

8. Planning Applications And Submissions

Where instructed, PAS may prepare and/or submit planning applications on your behalf.

​

This may include completing application forms, uploading drawings, preparing documents, liaising with the council and monitoring application progress.

​

Council validation and decision times are outside our control.

​

We are not responsible for:

​

  • council delays

  • validation delays caused by council workload

  • requests for additional information

  • neighbour objections

  • consultee comments

  • planning policy changes

  • refusal of planning permission

  • conditions imposed by the council

  • enforcement action arising from works already carried out

  • appeal outcomes

  • decisions made by the local planning authority

​

Unless agreed otherwise, council application fees and statutory fees are payable separately by you.

​

​

9. No Guarantee Of Planning Approval

PAS will use reasonable care and skill when providing services.

​

However, no planning consultant, architectural designer or application service can guarantee a successful planning outcome.

​

The final decision rests with the council or relevant authority.

​

We do not guarantee that:

​

  • an application will be validated

  • planning permission will be granted

  • a lawful development certificate will be issued

  • conditions will be acceptable

  • objections will not be received

  • enforcement action will not be taken

  • a project will be approved exactly as submitted

​

​

10. Timescales

Any timescales we provide are estimates unless expressly confirmed in writing as fixed dates.

​

Timescales may be affected by:

​

  • client response times

  • availability of property information

  • survey access

  • changes to the brief

  • council validation delays

  • council decision periods

  • third-party consultant availability

  • specialist reports

  • statutory consultation periods

  • public holidays

  • workload

​

PAS is not liable for delays outside our reasonable control.

​

​

11. Fees, Payments And VAT

Fees will be set out in our quotation, invoice, payment page or written agreement.

​

Payment terms will depend on the service being provided.

​

We may require full payment, staged payments, deposits or payment before release of drawings, documents or submissions.

​

Unless stated otherwise:

​

  • council fees are not included

  • specialist consultant fees are not included

  • statutory fees are not included

  • printing, postage or courier costs are not included

  • additional work is chargeable

  • VAT will be added where applicable

​

We may suspend work, withhold drawings, pause submissions or decline further services if payment is overdue.

​

​

12. Additional Work And Changes

The quoted fee covers only the agreed scope of work.

​

Additional fees may apply for:

​

  • design changes

  • revised layouts

  • extra drawings

  • additional application types

  • council-requested amendments

  • further supporting documents

  • new surveys or site visits

  • planning objections requiring response

  • meetings with councils or consultants

  • appeal work

  • resubmissions

  • retrospective planning issues

  • work caused by inaccurate information supplied by you

We will normally advise you before carrying out chargeable additional work.

​

​

13. Third-Party Consultants And Reports

Some projects may require specialist input, such as structural engineering, ecology, flood risk, heritage, arboriculture, highways, drainage, contamination, energy, fire safety, party wall or legal advice.

​

Where third-party consultants are required, their fees, timescales and terms may be separate from ours.

​

PAS is not responsible for the acts, omissions, advice, delays, fees or decisions of independent third-party consultants or statutory bodies.

​

​

14. Site Visits, Surveys And Access

Where a site visit, inspection or survey is agreed, you are responsible for ensuring safe and reasonable access to the property.

​

You must tell us in advance about any access restrictions, hazards, unsafe areas, pets, alarms, tenants, locked areas or other issues that may affect access.

​

If a visit cannot proceed due to access problems, missed appointments or unsafe conditions, a further visit may be chargeable.

​

​

15. Consumer Cancellation Rights

If you are a consumer and you purchase services from us online, by telephone or by email, you may have a legal right to cancel within 14 days.

​

We will not normally begin work during the 14-day cancellation period unless you ask us to do so.

​

If you ask us to start work during the cancellation period, you agree that:

​

  • we may begin providing the service before the cancellation period ends

  • you must pay for work carried out up to the point of cancellation

  • any refund may be reduced to reflect work already completed

  • where a service has been fully completed with your agreement, your right to cancel may be lost

​

To cancel, you must contact us clearly in writing using the contact details on this website.

​

This does not affect your statutory rights.

​

​

16. Business Clients

If you instruct PAS as a business, company, landlord, developer, investor or commercial client, cancellation rights may differ from consumer cancellation rights.

​

Business clients are liable for fees for all work carried out, time spent, expenses incurred and third-party costs committed up to the date of cancellation.

​

​

17. Refunds

Refunds are considered according to the type of service, the stage reached and the work completed.

​

Paid consultancy, desktop reviews and professional advice are generally chargeable once work has started or advice has been provided.

​

Drawings, documents and application work are chargeable according to the work completed.

​

Where work has been properly carried out with reasonable care and skill, a refund will not usually be due simply because:

​

  • the client changes their mind

  • the project does not proceed

  • planning permission is refused

  • the council asks for more information

  • the client decides to use another provider

  • the property is sold

  • the project becomes unaffordable

  • the client no longer requires the service

​

​

18. Intellectual Property And Use Of Drawings

Unless agreed otherwise, all drawings, documents, reports, designs, written material, images, templates, website content and other materials prepared by PAS remain the intellectual property of APN Home Limited or the relevant creator.

​

Once our fees have been paid in full, you are granted a licence to use the drawings or documents for the specific property and project for which they were prepared.

​

You must not copy, reuse, sell, transfer, adapt or use our drawings or documents for another property or project without written permission.

PAS may withhold files, drawings or documents until all fees are paid.

​

​

19. Website Content And Images

The text, images, watercolour illustrations, layouts, graphics, branding, logos and content on this website are owned by or licensed to APN Home Limited unless stated otherwise.

​

They must not be copied, reproduced, scraped, downloaded, reused, republished, altered, sold or used on another website without written permission.

​

This includes use by other web designers, agencies, competitors, automated systems or AI training datasets, unless expressly permitted by law.

​

​

20. Privacy And Data

We will process personal information in accordance with our Privacy Policy.

​

You should read our Privacy Policy alongside these Terms & Conditions.

​

We may use your information to respond to enquiries, provide quotations, deliver services, submit applications, liaise with councils or consultants, manage payments and keep project records.

21. Communication

We may communicate with you by email, telephone, online forms, video call, post or other reasonable methods.

​

You are responsible for checking emails, responding promptly and ensuring that your contact details are correct.

​

PAS is not responsible for delays caused by missed emails, incorrect contact details, spam filters or delayed client responses.

22. Limitation Of Liability

Nothing in these Terms & Conditions limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to that, PAS is not liable for:

​

  • loss of profit

  • loss of development value

  • loss of opportunity

  • loss of sale

  • loss of rent

  • loss of finance

  • loss caused by planning refusal

  • loss caused by council delay

  • loss caused by inaccurate client information

  • loss caused by third-party consultants

  • indirect or consequential losses

​

Our total liability will not exceed the fees paid to us for the specific service giving rise to the claim, unless the law requires otherwise.

​

​

23. Suspending Or Ending Services

We may suspend or end services if:

​

  • payment is overdue

  • required information is not provided

  • the scope of work changes materially

  • the project becomes inappropriate or impractical to continue

  • there is abusive, threatening or unreasonable behaviour

  • there is a conflict of interest

  • continuing would place us in breach of law, regulation or professional standards

​

You may end the service by giving written notice, but you remain responsible for fees, work completed and costs incurred up to that point.

​

​

24. Complaints

If you are unhappy with any part of our service, please contact us in writing so we can review the matter.

​

Please provide:

​

  • your name

  • property address

  • project reference if available

  • the issue you want reviewed

  • copies of relevant emails, drawings or documents

​

We will aim to respond within a reasonable time.

​

​

25. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

​

If you are a consumer living outside England and Wales, you may also have rights under the mandatory laws of your home jurisdiction.
